RULES
The terms and conditions of the services of this e-shop MB “KŪL by VABU” (hereinafter - the Rules) are a binding legal document for the Buyer and MB “KŪL by VABU” (hereinafter - the Seller) defining the rights and obligations of the Parties, acquisition of goods, payment for them, delivery and return conditions and procedures, as well as other conditions related to the purchase and sale of goods in the e-shop.
For the purposes of these Rules, a buyer is a person who has registered for an purchase without registering in the e-shop.
In the e-shop you can buy:
- active natural person, i. a person who has reached the age of majority and whose capacity is not restricted by court order;
- a minor between the ages of 14 (fourteen) and 18 (eighteen) who has the consent of his or her parents or guardians, except in cases where he or she is emancipated;
- legal person.
- Directly - via PaySera payment system;
- By bank transfer through the selected bank;
- Via PayPal system;
- Using a credit card.
By registering or placing an order without registration, the Buyer unconditionally confirms that he has the right to buy in the e-shop.
The Seller reserves the right to change, amend or supplement these Rules at any time. The Buyer is informed about the changes in the Rules on the e-shop website. The changes take effect from the moment of publication for all transactions concluded after the announcement, therefore the Buyer is recommended to get acquainted with the Rules during each purchase.
I. ORDER PROCEDURE AND CONDITIONS
When visiting the Seller's online store, the Buyer selects the goods he likes. Based on his choice, a shopping cart is formed.
After creating the shopping cart, the Buyer must enter the data necessary for the delivery of the selected goods: his name, surname, address to which the goods will be delivered, telephone number and additional information that may be relevant for delivery of the ordered goods.
The Seller confirms that the data provided by the Buyer will be used exclusively for the purposes of sale and delivery of goods, without violating the requirements for the protection of personal data provided by the legal acts of the Republic of Lithuania.
Next, the Buyer must choose one of the possible payment methods in the Seller's e-shop (for more details, see Section III of the Rules). At the same time, the method of delivery of goods is chosen.
The last window generates all the data provided by the Buyer, before which the Buyer must make sure that the provided data is correct and in accordance with his wishes. The buyer has the opportunity to correct incorrect data before sending the order. The Buyer is also given the opportunity to adjust the personal data necessary for the delivery of the goods, after informing the Seller tel. +370 65773087 or by e-mail kulbyvabu@gmail.com.
Changes to the delivery information may affect the delivery time and date. The Buyer is not given the opportunity to confirm the order until he notes that he is familiar with and agrees to the Seller's terms and conditions of service.
In case the Buyer is not familiar with the terms and conditions of the Seller's services before choosing the goods, he must do so before confirming his order and the data provided therein.
After the Buyer confirms the order, it is sent to the Seller.
The order is considered submitted from the moment it is received by the Seller. At the same time, in such a case, it is considered that a purchase agreement has been concluded between the Buyer and the Seller. Such a contract shall be deemed enforceable only from the moment the Seller receives confirmation of payment for the goods.
The Seller 's system automatically generates an order for the Buyer and sends the Buyer an e - mail indicating the ordered goods and the data provided by the Buyer.
When the Seller receives a confirmation of payment, it is considered that the purchase and sale agreement between the Buyer and the Seller is commenced.
The order submitted by the Buyer is stored in the Seller's database in accordance with the requirements of the applicable legal acts of the Republic of Lithuania regarding the term of storage of such data.
In all cases, the Buyer is considered to be familiar with and unconditionally agree to all terms and conditions when placing the order.
The contract is concluded and executed in Lithuanian.
II. WARRANTY AND PRICING OF GOODS
The characteristics of each product are collectively indicated next to each product in the Seller's e-shop.
The Seller indicates, and the Buyer confirms that he is aware that the goods listed in the Seller's e-shop, their color, shape or other parameters may not correspond to the actual size, shape and color of the goods due to the characteristics of the monitor used.
The Buyer agrees that by placing an order electronically in the Seller's e-shop, he undertakes to pay the price indicated in the order for the goods.
Prices in the Seller's e-shop and order are indicated in euros with VAT.
The seller sells goods that meet the conditions specified in the order. In cases where the goods delivered to the Buyer do not meet certain order requirements, the Buyer agrees to first immediately notify the Seller by telephone, and the Seller undertakes to take all steps to eliminate existing defects, if such defects are due to the Seller or third parties acting on its behalf. The Seller has the right to defend its rights in accordance with the procedure provided for in the Civil Code of the Republic of Lithuania if the Seller fails to eliminate the defects within a reasonable term agreed with the Buyer.
Seller's obligations in relation to the goods: The seller undertakes to deliver the goods of the appropriate quality and meeting the requirements set out in the order.
The Seller undertakes to provide the Buyer with the quantity of goods specified in the order. The Seller shall not be liable in cases where the quantity of the transferred goods is not accurate due to the fact that the Customer has incorrectly indicated the data in the order submitted to the Seller.
In cases when the order provides for a certain set of items, the Seller undertakes to provide all the items included in the set of items.
The goods are delivered packaged according to their nature in order to make the goods fit for their intended use.
III. PAYMENT PROCEDURE AND TERMS
It is safe and easy to pay for selected goods in the Seller's e-shop. The buyer pays for the purchased goods in one of the following ways:
If the Buyer has chosen one of the online payment methods, he undertakes to pay for the ordered goods immediately, otherwise he loses the right to make claims for violation of delivery terms, because according to the Buyer's order the consignment starts
IV. RETURNING THE GOODS
Quality goods can be returned within 14 days from the date of receipt. Deficiencies of sold low-quality goods are eliminated, low-quality goods are replaced and returned in accordance with the provisions of the Civil Code of the Republic of Lithuania and the “Retail Trade Rules” approved by the resolution of the Government of the Republic of Lithuania.
Low-quality purchases that do not meet the standards that existed at the time of purchase are returned or replaced.
To return the goods, write us an e-mail. email kulbyvabu@gmail.com or notify tel. +370 657 73087 and inform about intention to return or replace items. We will agree on the conditions for changing to another size / model or return.
Defective goods are replaced or returned in accordance with the return and exchange rules approved in 2001. June 29 by the order of the Minister of Economy (Order No. 217 “On Approval of the Rules for the Return and Exchange of Items”).
You can return the product purchased in the seller's e-shop within 14 calendar days of delivery.
- You can return or exchange the goods free of charge by courier.
- The returned product must be unused and undamaged, the label must not be removed from the product, the product is complete.
- Attach an invoice or a copy of it and your bank account number (20 digits) to the item being sent, along with your name, for a refund.
- Upon receipt of the returned product and evaluation of it, we undertake within 5 days. transfer money to the account specified by you for the purchased product, but we do not reimburse delivery and courier services.
- Upon receipt of damaged packaging or goods that do not meet the requirements of the return rules, we will return it to the sender.
For goods purchased via e-mail shop, the money will be returned to you by bank transfer to the account specified by you within 5 days. d. from the date of receipt of the returned goods.
When returning the goods to the Seller, the Customer must in all cases provide the Seller with the documents for the purchase of goods.
V. DELIVERY OF GOODS
The Seller undertakes to deliver the goods to the Buyer no later than within 3 working days from the receipt of the order payment confirmation.
When ordering the goods, the buyer undertakes to indicate the method and place of delivery of the goods.
The buyer undertakes to accept the goods himself. In case he cannot accept the goods himself and the goods have been delivered to the specified address and on the basis of other data provided by the Buyer, the Buyer has no right to make claims to the Seller regarding delivery of the goods to the wrong entity.
Goods ordered in the Seller's online store are delivered by courier services or through the post office chosen by the Buyer.
Delivery of goods via courier service:
- 3.00 Eur - delivery price, when the order amount is up to 29.99 Eur.
- FREE delivery for orders from 30.00 Eur.
- After confirming and paying for the order (on working days) we will deliver the goods within the period up to 5 days. d.
Delivery of goods through post office terminals:
- 2.50 Eur - delivery price, when the order amount is up to 29.99 Eur.
- FREE delivery for orders from 30.00 Eur.
- After confirming and paying for the order (on working days), we will deliver the goods within the period up to 5 days.
VI. OTHER PROVISIONS

The Agreement is concluded, executed and all communication between the Buyer and the Seller takes place in the state language.
The buyer has the right to withdraw from the contract within 14 days without any additional conditions. Such term begins to count from the moment when the goods are handed over to the Buyer according to the contract (order).
The Buyer may exercise this option only if the item (product) has not been damaged or the appearance of the item has not substantially changed, nor has it been used (changes to the packaging to the extent necessary to inspect the item are not considered essential).
